What Is Gratuity in the UAE?
Gratuity is a lump-sum payment employers must make to eligible employees when their employment ends. It is calculated based on the employee’s basic salary and length of service, excluding allowances, bonuses, and commissions.
According to the Ministry of Human Resources and Emiratisation (MOHRE), gratuity is a statutory right for all employees who complete at least one year of continuous service.
Who Is Eligible for Gratuity in 2025?
Employees qualify for gratuity if they:
- Have completed 1+ year of continuous service.
- Resign or are terminated without gross misconduct.
- Worked under limited or unlimited contracts (the law is now unified).
Gratuity is not paid if:
- The employee has served less than one year.
- The employee is terminated for reasons listed under Article 44 (disciplinary dismissal).
UAE Gratuity Calculation Formula
The formula is based only on the basic monthly salary (not total package).
- Less than 1 year of service → No gratuity.
- 1–5 years of service → 21 days’ basic salary for each year.
- 5+ years of service → 30 days’ basic salary for each year beyond the first 5.
Example 1: Employee with 3 years of service
- Basic salary: AED 8,000
- Gratuity = 21 days × (8,000 ÷ 30) × 3 = AED 16,800
Example 2: Employee with 7 years of service
- Basic salary: AED 12,000
- First 5 years: 21 days × (12,000 ÷ 30) × 5 = AED 42,000
- Next 2 years: 30 days × (12,000 ÷ 30) × 2 = AED 24,000
- Total gratuity = AED 66,000
Note: Gratuity cannot exceed the equivalent of 2 years of wages (Article 52, Labour Law).
